Terms & Conditions

The Chocolatiers (“Us”) are committed to providing excellent customer satisfaction and an excellent service. These terms and conditions shall govern the supply of goods sold by Chocolatiers which is a trading name for Chocolatiers (UK) Limited (No. 08138219) of 5 Hall Terrace, Great Sankey, Warrington, Cheshire, WA5 3EZ United Kingdom to the Customer (“You”) and shall constitute the entire and only agreement between us in relation thereto.

1. The contract between us

1.1. When you receive confirmation of your order, this is only to indicate that we have received your order. It does not indicate that a contract exists between us even if payment is taken.
1.2. The completion of the contract between you and us will take place on the despatch to you of the goods ordered unless we have notified you that:
1.2.1. we do not accept your order;
1.2.2. we cannot deliver to your area;
1.2.3. your goods are out of stock;
1.2.4. the goods you ordered were listed at an incorrect price or weight due to a typographical error or an error in the pricing information received by us from our suppliers; or
1.2.5. you have cancelled the contract in accordance with Section 4.
1.3. Your goods will not be dispatched until full payment is received for your goods.
1.4. In the event that your order is refused, we will notify you by e-mail and we will refund any sum deducted by us from your credit card as soon as possible within 30 days of your order.

2. Prices and Payment

2.1. The price payable for the goods you order is set out on our website (www.chocolatiers.co.uk) at the time you place your order.
2.2. Payment shall be made using our online payment facility provided by PayPal unless otherwise agreed by us.
2.3. Voucher codes issued by us may be redeemed on our website but will be subject to separate terms and conditions. We reserve the right to reject the use of voucher codes at any time.
2.4. In the event that an error in price occurs on our website, we will not be obliged to supply the goods at the incorrect price.
2.5. All prices are inclusive of VAT where applicable at the rate of 20%.
2.6. We reserve the right to change prices without notice. Please contact us to confirm prices.

3. Our Products and Nuts

3.1. All goods sold by us may contain traces of nuts.

4. Cancellation and returns for online purchases

4.1. To cancel or return your goods ordered online and to receive a refund you must notify us first. You can do this by logging into our returns service and submitting your information.

4.2. You may cancel the contract for your goods and receive a refund for the goods you order online for any reason at any time up until the end of the seventh day from the date you received the ordered goods. The goods must be returned to the address under Section 4.1 above at your cost within 7 working days thereafter in their original selling condition.
4.3. You may return your goods and receive a refund for goods that are not fit for purpose or are of unsatisfactory quality at any time up until the end of the 28th day from the date you received the ordered goods.
4.4. Where the goods are being returned because they are faulty or not fit for purpose, we will meet the cost of return on the condition that the carrier is nominated by us.
4.5. The goods shall remain your responsibility until we have received delivery and checked the goods.
4.6. You must exercise reasonable care and skill when packaging the item in order to ensure its safe return. It is strongly advised that you take out additional postage insurance to cover the value of the goods.

5. Deliveries
All goods will be dispatched as soon as possible subject to the following guidelines:
5.1. Deliveries shall only be made to addresses within the UK mainland and Northern Ireland. Please see Section 5.5 for excluded zones in the UK.
5.2. For orders up to £7.50, standard 3-5 working day delivery by Royal Mail is £2.29 excluding VAT (Monday – Friday excluding Public Holidays). For orders from £7.51 to £19.99 delivery is £3.39+vat and for orders from £20.00 to £44.99 delivery is £3.69
5.3. For orders of £45.00 or above are delivered by Royal Mail or courier free of charge.
5.4. Chocolatiers shall not be responsible for late deliveries.

6. Privacy

6.1. All personal information collected and stored on our database is handled strictly in accordance with the Data Protection Act 1998 and the Privacy and Electronic Communications Regulations.
6.2. We do not disclose your information to third parties other than when order details are processed as part of the order fulfilment. In this case, these parties will not disclose any of the details to any other party.
6.3. Any payment details entered on our website are transmitted over a secure (SSL) connection and stored using 128-bit encryption with a PCI compliant company.

7. Re sale of our goods

7.1. You are not permitted to sell our goods and you must not offer for sale or re-sale any of our goods.

8. User Reviews

8.1. Chocolatiers reserves the right to remove any material submitted or posted by you as a review, without notice to you, if it becomes aware and determines, in its sole and absolute discretion that the content of the review is inappropriate or offensive.
8.2. By sending us your comments on this website you agree to authorise Chocolatiers to print, edit and redistribute this material.

9. Our Liability – It is very important that you read this warning and disclaimer

9.1. Save as precluded by law, we shall not be liable to you or any third party for any indirect, direct, consequential or economic loss whatsoever and this shall include, but not be limited to, loss of revenue, loss of profit, loss of opportunity, loss of goodwill, loss of work.
9.2. We shall not be liable for any claim for damage or loss whatsoever in excess of the value of the goods purchased.

10. Intellectual Property

10.1. The content of this website is protected by copyright, database right, trademarks and other intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on this website without written permission from a director of Chocolatiers.

11. Events beyond our control

11.1. We shall have no liability for any delay or failure to deliver the goods you have or for any damage or defect to the goods delivered that is caused by any event or circumstance beyond our reasonable control which shall include, but not be limited to, snow, ice, floods or other such severe weather conditions, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, fire, explosion or accident.

12. Illegality

12.1. In the event that a provision of these terms and conditions is declared illegal or invalid or unenforceable for any reason, such provisions shall be removed from these terms and the remainder of the terms shall continue in full effect.

13. Third party rights

13.1. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no person other than Chocolatiers and the Customer shall have any rights under it.

14. Entire agreement
14.1. These terms and conditions, together with our privacy policy, set out the whole of our agreement relating to the supply of goods to you by us.
14.2. Except where you are dealing as a consumer, nothing said by any sales person on our behalf should be construed as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us; and,
14.3. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

15. Governing Law

15.1. These terms and conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be referred to an independent arbitrator and governed by and construed in accordance with English law.
15.2. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that cannot be resolved by an independent arbitrator.
